Unemployment Compensation (UC)
During a Furlough
· Office of Human Resource is required to provide employees with a Standard Form (SF) 8 if they will be in a non-duty status for seven or more days.
o The 3-digit Federal agency code is 460 for Department of Health and Human Services.
o The address on the SF-8 should be the address for the Department of Health and Human Services Office that services you. Each OPDIV has a representative assigned to process claims.
· Furloughed employees stationed overseas are not eligible to file for UC benefits unless they return to the United States. Their UC claim would then be based on their state of residence.
o Employees who are stationed overseas may not file a retroactive claim when they return to the U.S. at the end of their tour of duty. None of the State Employment Security Agencies (SESA) would backdate a claim two years. If an UC claim was filed at that time, the claim would be effective when it was filed and not retroactive to the time of the furlough.
· Excepted employees cannot file a UC claim, since they are not unemployed. In addition, in order to receive UC benefits, an individual must be able and available to accept work. Excepted employees would not meet this requirement since they are already working.
· Employees may apply for benefits upon furlough however will not become eligible to receive benefits until they have been out of work for seven days.
· Employees must have had a certain amount of employment/wages within a base period of one year as specified in the State law.
· UC claims are not based on the state in which an individual resides, but instead on the state in which the work was performed (this does not include overseas employees). The amount of weekly benefits and the period for which benefits will be paid will generally be determined by the law of the State in which the employee had their last official duty station. (i.e., the state in which the work was performed).
· In the event a decision for returning to work after furlough would include back pay entitlements, employees could be subject to indebtedness based on SESA UC law. The decision on whether or not employees would have to pay back UC benefits would be decided by each SESA based on their UC law. Overpayment requirements apply to all employees for a particular state, regardless of their grade or salary.
· Upon return to work, employees are required to notify the local SESA, in writing, to discontinue paying benefits.
